In 2023, Pennsylvania discontinued the “old venue” rule. This rule required victims of medical malpractice to file their cases in the county where the malpractice happened. Plaintiffs are now able to file wherever the medical provider does business. Ultimately, this has led to more medical malpractice cases being filed in Philadelphia, where it is believed that jurors favor the Plaintiffs.
The Pennsylvania Supreme Court reviewed this ruling in February 2026 and decided not to re-instate the “old venue” rule. Do you agree with this ruling, or do you believe it puts Plaintiffs at an unfair advantage? Please explain your opinion on this ruling citing case law.
